Terms of Service

1. Acceptance of Terms

By using the Services, you accept and agree to these Terms, whether or not you create an account. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 13 years old to use the Services. If you are under 18, your use must be supervised by a parent or legal guardian who agrees to these Terms. By using the Services, you represent that your activities are lawful in your jurisdiction.

3. Account Registration and Responsibilities

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and current information. You are responsible for all activity that occurs under your account and must immediately notify aSuggestion of any unauthorized use. aSuggestion may suspend, restrict, or terminate your account if you violate these Terms, engage in harmful behavior, or for operational reasons.

4. User Conduct and Safety

Users must not engage in any behavior that is abusive, unsafe, or harmful, including but not limited to:

• Harassment, intimidation, or threats
• Stalking or predatory behavior
• Grooming or exploiting minors
• Manipulation or disruption of discussions
• Coordinated harassment or targeted attacks
• Impersonation of others
• Posting content that incites violence or discrimination

aSuggestion may remove content, suspend accounts, or permanently terminate accounts for violations, at its sole discretion.

5. Membership and Account Use

Users may become Members by subscribing or signing up for premium features. Membership fees, if applicable, are non-refundable except where required by law.

6. Content

You retain ownership of content you post ("User Content"), but grant aSuggestion a worldwide, royalty-free, sublicensable license to use, host, store, reproduce, modify, communicate, publish, and display such content in connection with the Services. You are solely responsible for your User Content and must not post illegal, infringing, harmful, or unsafe content.

7. Rights and Restrictions

You may not:

• Use the Services for unlawful purposes.
• Circumvent security, manipulate features, or disrupt service operation.
• Reverse engineer software or attempt unauthorized access.
• Sell, distribute, or commercialize the Services or Software without authorization.
• Use Services to threaten life, property, or personal safety.

8. Additional Terms

Certain Services, features, or software may have Additional Terms. You must accept these to access those features.

9. Payment and Fees

You are responsible for all applicable fees for Services you use. Failure to pay may result in suspension or termination of your account. Fees are non-refundable except where legally required.

10. Termination

aSuggestion may suspend or terminate your account at any time, with or without cause. You may also terminate your account at any time. Sections relating to liability, indemnity, disputes, and intellectual property survive termination.

11. Linking

11.1 Linked Services

Third-party services may be linked to or accessible via the Services. These are not controlled by aSuggestion, and you use them at your own risk.

11.2 Hyperlinks to aSuggestion

You may link to the Services only in compliance with rules prohibiting use of logos, trademarks, or misleading implications of affiliation. aSuggestion may revoke linking rights at any time.

12. Member Disputes

You are responsible for your interactions with other users and third parties. aSuggestion may intervene if necessary but is not obligated to do so.

13. Privacy and Communications

13.1 Privacy Policy

Use of the Services constitutes acceptance of the aSuggestion Privacy Policy.

13.2 Communications

aSuggestion may send notifications, marketing, and operational communications. You may adjust preferences, but essential account communications may still be sent.

13.3 Electronic Communications

Electronic notices satisfy legal writing requirements. aSuggestion is not obligated to respond to all inquiries.

13.4 Law Enforcement

aSuggestion may disclose information to authorities to comply with legal requests or protect users.

14. Disclaimers

The Services are provided "AS IS" and "AS AVAILABLE". aSuggestion disclaims all warranties, express or implied, including accuracy, reliability, security, or fitness for purpose.

15. Limitation of Liability

aSuggestion shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits or data. Liability is capped at the amount paid to aSuggestion during the relevant membership period.

16. U.S. Export Controls

Software may not be exported in violation of U.S. laws, including sanctions and export regulations.

17. Arbitration and No Class Action

Disputes must first attempt resolution through a 60-day written notice and good-faith negotiation. If unresolved, binding arbitration under JAMS rules applies where legally permitted. Arbitration is individual only; no class actions or consolidated claims.

18. Other Dispute Resolution

Where arbitration is prohibited, disputes are resolved in courts in Litchfield, Connecticut, with written notice and a 60-day negotiation period.

19. Indemnification

You agree to indemnify and hold harmless aSuggestion, its affiliates, officers, and employees from any claims arising from:

• your use of Services
• violation of laws or Terms
• content you provide
• infringement of rights

20. Wireless Features

Wireless access may involve data or messaging fees from carriers. Location-based services may collect location information, consistent with the Privacy Policy.

21. Operation and International Use

Services are controlled from the U.S. Use from other countries is at your own risk, and compliance with local law is your responsibility.

22. Software License

aSuggestion grants a limited, non-exclusive, non-transferable license to use software only for accessing Services. You may not reverse engineer, copy, redistribute, or use software for unsafe or illegal purposes. License may be revoked at any time.

23. General Terms
